摘要：本文简要介绍了国际植物新品种保护制度,国内外植物新品种保护发展现状,并且就未来植物新品种保护的发展趋势进行分析,指出了我国植物新品种发展道路上可能面临的挑战和机遇。另外,针对植物新品种保护、品种审定以及国际栽培品种登录三者在相关概念、品种申报与管理等方面的差异进行了比较分析。旨在让更多的育种者了解植物新品种保护相关的基本知识与概念,提高育种者知识产权保护意识,使得育种者的合理权益得到保护。
A brief introduction of the International Convention for the Protection of New Varieties of Plants is provided by reviewing the development history of the International Convention and the international Union for the Protection of New Varieties of Plants. Current status and development trends of implementation of the Protection of New Varieties of Plants are presented to provide a general picture of the system in China and the world. An analysis is conducted to identify challenges and opportunities for implementing protection of new varieties of plants in China. Moreover, comparisons among the protection of new varieties of plants, the international cultivar registration, and the certification of genetically improved propagation materials are made to clarify the differences among the three major systems related to artificially bred plant verities in terms of definition, technical requirements, fundamental objectives and practical applications. The purpose of this paper is to raise the awareness of plant breeders of protection of new varieties of plants and to promote the development of new varieties of plants.
