摘要：解读了美国雷斯法2008年修正案的主要特点、实施阶段和处罚细则,分析了法案本身存在的制度缺陷、道德风险和贸易影响等问题,提出了企业完善内部管理增强应对力和借助外部环境提高竞争力的应对策略,对于中国企业迎接各种挑战、促进林产品可持续贸易和推动林业产业健康发展有重要参考意义。
US Lacey Act Amendments had focused the illegal taking and trade of global plant and products thereof,recognized and supported the effort of the other sates to manage the national natural resources. The main characteristics,implementation phases and detailed punishment rules of the Lacey Act Amendment were briefly introduced. The problems,such as system objection and moral hazard of act itself and its great effect in international regular trade,were analyzed in detail. Finally,the countermeasure strategies,such as perfect inner management to enhance manipulation capacity,and depend on exterior condition to heighten the competitive power for the Chinese forestry enterprises to accept the different challenges,were put forward in this paper to promote the sustainable trade of forest product and drive healthy development of forestry industry.
