摘要：在非法采伐及相关贸易成为国际社会热点问题的背景下,越来越多的国家通过立法限制非法采伐木材进入本国市场。文中对当前国际上主要木材合法性贸易法规进行梳理,针对合法性定义、强制性、适用对象、保障机制、执行与管理、监督机制以及处罚措施7个立法要素进行比较分析,总结国际打击非法采伐及相关贸易的立法经验对我国木材合法来源管理的借鉴意义。
In the backdrop of illegal logging and related trade becoming a hot concern in the international community, more and more countries have resorted to legislation to restrict the access of illegally logged timber to their domestic market. This paper reviews the timber legality regulations across the world, and comparatively analyzes the seven legislative elements of the definition of legality, mandatory, regulated subjects, obligations, enforcement, supervision mechanisms and penalties, and summarizes the international legislation experiences on combating illegal logging and related trade, which could be the reference for the future development of timber legality regulation in China.
