摘要：根据《生物多样性公约》所达成的《名古屋议定书》,世界各国对遗传资源保护和利用的重视程度又提高了一个层次,而林木资源作为遗传资源的重要组成部分也逐渐成为了人们所关注的重点。文中对国内外林木遗传资源获取和惠益分享的现状、发展趋势和存在的问题进行分析,从我国现有的林木遗传资源法律法规框架出发阐述我国林木遗传资源获取与惠益分享所面临的困难和机遇,同时提出对我国林木遗传资源管理的建议。
In line with the ＂Nagoya Protocol＂ under ＂Convention on Biological Diversity＂, countries pay more attention to genetic resources protection and utilization, and forest resources as an important component of genetic resources have become the concerns. This paper analyzed the status, development trends and problems of forest genetic resources access and benefit-sharing at home and abroad. Based on our existing legal and regulatory framework, the paper shed light on the difficulties and opportunities facing the access and benefit-sharing of forest genetic resources ; at the same time, reasonable measures that should be adopted were given for the management of forestry genetic resources.
